One year suspension recommended for Florida prosecutor’s ex parte contacts with judge

Former Florida homicide prosecutor Howard Scheinberg was found guilty of professional misconduct and a referee for the Florida bar has recommended a one-year suspension, for misconduct while trying a death penalty case.  According to the Sun-Sentinel, Scheinberg had 949 phone calls and 471 text messages with Judge Ana Gardiner during the trial.

The former judge was not sanctioned by the Judicial Qualifications Commission, but is now facing allegations by the Florida Bar that she “misled the Judicial Qualifications Commission into believing her contact with Scheinberg from March through August 2007 was minimal.”
